Forth Energy is seeking consent under Section 36 of the Electricity Act 1989 to construct and operate proposed renewable energy plants at the ports of Dundee, Grangemouth and Rosyth. Applications of this nature are made directly to the Scottish Government’s Energy Consents and Deployment Unit to be considered by Scottish Ministers.

Statutory consultees to the Section 36 process include the relevant local planning authority, Scottish Natural Heritage (SNH) and Scottish Environment Protection Agency (SEPA).
